1. Introduction

These Terms and Conditions ("Terms") govern your access to and use of the website indur.co.uk and the associated software-as-a-service platform (together, the "Service"), operated by Indur ("we", "us", "our"). By creating an account or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 16 years old (or the age of digital consent in your jurisdiction) to use the Service. By using the Service, you represent that you meet this requirement and that you have the legal capacity to enter into these Terms.

3. Accounts

  • You must provide accurate and complete information when creating an account.
  • You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
  • You must notify us immediately at lewismarsden.indur@gmail.com of any unauthorized use of your account.
  • We reserve the right to suspend or terminate accounts that violate these Terms.

4. Subscriptions, Fees, and Payment

  • Certain features of the Service require a paid subscription. Applicable fees will be displayed at the time of purchase.
  • Payments are processed via third-party payment processors (e.g., Stripe). By providing payment information, you authorize us (via our processor) to charge the applicable fees.
  • Subscriptions may renew automatically unless cancelled before the renewal date, in accordance with the plan details shown at sign-up.
  • Except where required by law, fees are non-refundable. Any refund policy specific to a plan will be stated separately at checkout.
  • We may change pricing with reasonable advance notice; continued use after a price change constitutes acceptance of the new pricing.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of these Terms;
  • Attempt to gain unauthorized access to the Service, other accounts, or our systems;
  • Interfere with or disrupt the integrity or performance of the Service;
  • Upload malicious code, viruses, or harmful content;
  • Reverse-engineer, decompile, or attempt to extract the source code of the Service, except as permitted by law;
  • Use the Service to infringe on the intellectual property or privacy rights of others;
  • Resell, sublicense, or redistribute the Service without our written consent.

We reserve the right to suspend or terminate access for any user who violates this section.

6. User Content

  • By uploading User Content, you grant us a limited, non-exclusive license to host, store, process, and display that content solely to provide and improve the Service.

The Service, including its software, design, branding, and content (excluding User Content), is owned by Indur or our licensors and is protected by intellectual property laws. Nothing in these Terms transfers any ownership rights to you, except the limited right to use the Service as permitted herein.

The Service may integrate or rely on third-party tools (e.g., payment processors, analytics providers, email platforms). We are not responsible for the availability, accuracy, or practices of third-party services, which are governed by their own terms and privacy policies.

9. Service Availability

We aim to keep the Service available and reliable but do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue any part of the Service at any time, with reasonable notice where practicable.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be error-free, secure, or uninterrupted.

11. Limitation of Liability

To the maximum extent permitted by law, Indur shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of or inability to use the Service. Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

Nothing in these Terms limits liability that cannot be limited under applicable law (e.g., liability for death, personal injury, or fraud).

12. Indemnification

You agree to indemnify and hold harmless Indur, its officers, employees, and agents from any claims, damages, liabilities, and expenses (including legal fees) arising from your use of the Service, your User Content, or your violation of these Terms.

13. Termination

  • You may stop using the Service and delete your account at any time.
  • We may suspend or terminate your access to the Service, with or without notice, if you violate these Terms or engage in conduct we reasonably believe harms the Service, other users, or third parties.
  • Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (e.g., intellectual property, limitation of liability, indemnification) will continue to apply.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales, except where mandatory local consumer protection laws grant you the right to bring a claim in your own jurisdiction.

15. Changes to These Terms

We may update these Terms from time to time. We will post the updated version with a revised "Last updated" date and, where changes are material, provide additional notice. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

16. Severability
